1099-NEC filing for staffing agencies and recruiters

October 13, 2026 Tax Form Hero Team 14 min read

Staffing agencies and recruiters generally file Form 1099-NEC when they pay a reportable nonemployee $2,000 or more for business services during tax year 2026. Independent sourcing fees, split-placement fees, and referral commissions can qualify; employee wages and employee bonuses belong on W-2. Confirm the worker relationship, recipient classification, payment method, and reporting payer before filing by February 1, 2027.

TL;DR
  • 1099-NEC for staffing agencies covers qualifying nonemployee services, not every worker paid outside payroll.
  • Reportable 2026 payments generally require a form at $2,000 per recipient; backup withholding creates exceptions.
  • Split-placement fees and referral commissions need recipient and payment-method review before reporting.
  • IRS filing and recipient copies for tax year 2026 are due February 1, 2027.
  • TaxFormHero supports reviewed spreadsheet imports and optional delivery; it does not determine employment status.

Once your annual recipient totals are reviewed, you can e-file Form 1099-NEC for recruiters and contractors through TaxFormHero. Prepare the reporting decisions first, then use manual entry or the form-specific Excel/CSV template to create the returns.

Why staffing agency 1099 reporting needs a separate review

A placement record does not identify the correct tax form. Your agency can collect a fee from a client, pay an employee recruiter a commission, and pay an independent sourcing partner for the same placement. Those are different transactions with different recipients and reporting rules.

Reconcile outgoing payments separately from client billings and payroll. An applicant-tracking system records placements, but an earned fee or completed assignment is not proof of a payment made during the calendar year.

Do not issue a 1099 to every person who appears on a placement roster. The agency's relationship with the worker, the client's role, and any payroll arrangement must be understood before deciding who reports wages or contractor compensation.

Need to get this filed? You can e-file Form 1099-NEC online with TaxFormHero, which is IRS-authorized and charges per form, not per month.

Which staffing and recruiting payments belong on 1099-NEC?

Form 1099-NEC reports qualifying business-service payments to reportable nonemployees. The IRS Forms 1099-MISC and 1099-NEC instructions establish the general $2,000 threshold for 2026, corporate exceptions, payment-card exclusions, and deadline rules.

Payment or arrangement General reporting treatment Verify first
Employee recruiter salary or commission W-2, not 1099-NEC Employment relationship and payroll treatment
Independent sourcer or recruiter fee Potentially 1099-NEC Recipient classification, annual payments, settlement method
Split-placement fee to another recruiting business Potentially 1099-NEC Actual payee and applicable corporate exemption
Nonemployee referral-service commission Potentially 1099-NEC Whether the payment compensates services
Temporary worker on employee payroll W-2 Responsible employer and reporting arrangement
Corp-to-corp consulting invoice Not automatically reportable or exempt Vendor's actual federal tax classification
Business office rent Generally consider 1099-MISC Rental reporting rules and exceptions

An LLC name, invoice, or “C2C” label does not settle the answer. Ordinary service payments to C or S corporations are generally exempt, while partnerships and disregarded entities need separate evaluation. Attorney fees have an exception to the corporate exemption.

Step 1: Determine worker status before choosing the form

Temporary assignments, remote work, or commission-only compensation do not automatically create independent-contractor status. The IRS worker-classification guidance considers behavioral control, financial control, and the type of relationship together. There is no single decisive factor or fixed number of factors that guarantees the result.

Evaluate the actual relationship for independent recruiters, sourcers, and placed professionals. Who directs the means and methods of work? Does the worker run an independent business, bear expenses, and have an opportunity for profit or loss? Document the complete facts rather than relying on the contract heading.

Staffing arrangements can involve more than one business. If the client supervises a worker or another company processes payroll, do not assume that fact alone resolves the agency's employment-tax responsibilities. Obtain advice on third-party payer and employer arrangements before changing reporting.

A particular caution applies to technical staffing. IRS Publication 15-A for 2026 limits Section 530 employment-tax relief for specified technical service specialists supplied to another business. This limitation does not itself classify every programmer or engineer as an employee; the common-law analysis still applies.

Before preparing the filing list:

  • Separate employee payroll records from nonemployee vendor payments.
  • Review former employees now invoicing for similar work.
  • Document agency and client control of placed workers.
  • Escalate uncertain classifications or technical-staffing arrangements.

Step 2: Collect W-9 details and identify the actual payee

Use certified reporting details, not the recruiter's invoice nickname or email signature. Request Form W-9 during onboarding, review the federal tax classification, and retain it securely.

For a disregarded single-member LLC, the W-9 generally identifies the owner on line 1 and the LLC on line 2, using the owner's taxpayer ID. An LLC taxed as a corporation follows a different reporting classification. Do not apply a blanket exemption to all recruiting companies ending in “LLC.”

The IRS W-9 requester instructions explain taxpayer identification, electronic collection, and backup withholding. A missing TIN is not permission to omit a reportable recipient; review the applicable withholding duties. Keep records of your requests and address withholding duties before further reportable payments.

For foreign sourcers or overseas recruiting partners, use the appropriate foreign-payee documentation and obtain advice on source-of-income, withholding, and reporting rules. Form W-9 is for U.S. persons; overseas services should not be forced into this domestic checklist.

Build a complete recipient record:

  • Certified name, TIN, tax classification, and address.
  • The agreement and description of services.
  • Evidence supporting any reporting exemption.
  • Optional name/TIN matching results and unresolved questions.

Step 3: Reconcile split fees, referrals, and sourcing payments

Calculate the agency's reportable outgoing payments—not the gross client placement invoice. Keep an annual reconciliation per reporting payer and recipient, combining qualifying payments across branches and payment systems without duplication.

Illustrative example: your agency collects a $20,000 placement fee and pays a reportable independent recruiter $6,000 by ACH for recruiting services. Assuming all reporting conditions are met, the agency reports $6,000, not the client's $20,000 payment and not the agency's $14,000 retained portion.

Illustrative example: a reportable sourcing partner receives $700, $800, and $900 by check for services during 2026. The total is $2,400. Report the entire $2,400, not only the $400 above the general threshold.

Employee referral bonuses and employee commissions stay in payroll reporting. A nonemployee referral fee for services can belong on 1099-NEC, but a prize not paid for services or another payment arrangement requires its own classification.

Refunds, placement guarantees, clawbacks, and repayments need care. Document what was actually paid and returned, and ask your adviser how the timing affects reporting rather than automatically netting a repayment in a different calendar year against an earlier form.

Your reconciliation should contain:

  • Legal payer and certified recipient identity.
  • Payment dates, amounts, and transaction references.
  • Split-fee or referral agreement references.
  • Settlement methods and documented exclusions.
  • Gross reportable compensation and any tax withheld.

Step 4: Exclude qualifying card and network transactions

Payment-card and qualifying third-party network transactions covered by section 6050W are excluded from your 1099-NEC reporting. Ordinary direct transfers, cash, and checks generally remain included when otherwise reportable.

An app name does not establish the settlement method. Review the actual transaction rather than excluding every PayPal, Venmo, or other app transfer. Do not duplicate an excluded payment simply because the recipient says no 1099-K arrived.

Illustrative example: a reportable recruiter receives $1,500 directly and $1,000 settled by credit card for services in 2026. The card transaction is excluded, leaving $1,500 for the agency's 1099-NEC calculation. Assuming no special requirement or backup withholding, the general federal threshold is not met.

Backup withholding changes the analysis. Report gross compensation before withholding and tax actually withheld separately in Box 4. A return can be required below $2,000 when backup withholding occurred.

Before applying the threshold:

  • Verify each transaction's settlement method.
  • Keep evidence for excluded amounts.
  • Remove duplicate transaction records.
  • Check withholding exceptions and state requirements separately.

Step 5: Choose direct IRS filing or provider-managed transmission

The general e-filing mandate begins at 10 covered information returns in aggregate, not 10 contractor forms alone. An agency with 8 W-2s and 3 Forms 1099-NEC has 11 covered returns, subject to applicable exceptions or waivers. W-2s still go to the Social Security Administration; 1099s use the applicable IRS route.

The IRS IRIS Taxpayer Portal supports manual entry and CSV imports. Direct use requires an IRIS-specific transmitter code and your own preparation and completion tracking.

Filing option Best for Advantage Limitation
IRS IRIS Taxpayer Portal Agencies managing direct IRS access Manual entry and CSV templates You manage setup, acknowledgments, and recipient furnishing
TaxFormHero Agencies with reviewed contractor totals Provider-managed transmission and optional delivery Does not resolve worker classification or uncertain tax treatment
Tax professional Agencies needing employment-tax or withholding advice Advice and filing within the agreed scope Complete records and clear responsibility assignments remain necessary

TaxFormHero is a pay-per-form 1099-NEC option for staffing agencies with reviewed recruiter and contractor data. It supports manual entry, Excel/CSV imports, multiple payer records, optional TIN matching, and recipient services without a subscription. Do not assume an applicant-tracking or payroll system connects automatically; use the documented import workflow.

Prepare the batch:

  • Select the correct payer, tax year, and form.
  • Use the form-specific template.
  • Preserve leading zeros in taxpayer IDs and ZIP codes.
  • Reconcile recipient counts and total amounts before uploading.

Step 6: Review drafts and complete IRS and recipient reporting

The tax year 2026 1099-NEC deadline is February 1, 2027 for both IRS filing and recipient copies. January 31 is Sunday. Electronic filing does not create a later regular 1099-NEC deadline.

Select tax year 2026 for payments made during 2026, even when submitting in 2027. Use the applicable 2026 revision and its instructions for compensation, withholding, and any additional fields. Do not import earlier-year corrections into the current-year batch.

TaxFormHero imports draft forms for review before submission. Check names, TINs, annual amounts, and service selections, then submit deliberately. Inspect acknowledgments afterward; checkout confirmation alone is not proof of IRS acceptance.

Recipient furnishing is separate. Download PDFs for your own distribution or select optional encrypted e-delivery or USPS first-class mailing. Electronic furnishing requires the applicable recipient consent, not just an email address. Allow time for furnishing and verify any extension eligibility separately from the regular deadline.

Complete these checks:

  • Confirm the payer identity and reviewed recipient totals.
  • Select delivery services only where appropriate.
  • Inspect acknowledgments and resolve rejected records.
  • Document furnishing and electronic consent where applicable.

Step 7: Review state obligations and resolve errors

Do not file in every state mechanically or assume federal acceptance completes state reporting. Requirements depend on the jurisdiction, form, income, withholding, payer, and recipient facts. Combined Federal/State Filing participation does not replace every direct submission.

If an accepted return contains an error, follow the correction procedure for the error and transmission channel. A rejected submission is not automatically an accepted-return correction. Keep original references and provide corrected recipient statements where required.

Separate penalties can apply to IRS returns and recipient statements. Applicable amounts depend on the year due and circumstances; prompt correction does not guarantee a specific penalty or relief. Avoid treating a 30-day interval as universal permission to postpone fixing rejected records.

TaxFormHero retains filing data and PDF copies for 4 years. This is a storage feature, not a universal legal retention rule for payroll records, W-9s, or every agreement.

Keep a completion file:

  • Required state submissions and their results.
  • Federal acknowledgments and error-resolution history.
  • Recipient furnishing records and corrected copies.
  • Source payment reconciliation, agreements, and W-9 documentation.

“A staffing agency's placement roster is not its 1099 filing list: classify the relationship and reconcile the actual payments first.”

Common staffing-agency 1099 mistakes

  • Treating everyone outside payroll as a contractor: classify the relationship before selecting the form.
  • Reporting the client invoice instead of the recruiter payment: reconcile outgoing compensation separately.
  • Assuming every C2C vendor is exempt: review the certified tax classification.
  • Mixing employee commissions with independent referral fees: keep payroll and vendor reporting separate.
  • Counting only 1099-NEC for the e-filing mandate: include other covered returns, including W-2s.

FAQ

Do staffing agencies issue 1099-NEC to temporary employees?

No. Employee wages belong on W-2, even for a short assignment. Staffing and client arrangements require a worker-status and employer review before choosing a reporting form.

Are independent recruiter commissions reported on 1099-NEC?

Generally yes when a reportable nonemployee receives at least $2,000 in qualifying business-service payments during 2026. Employee recruiter commissions belong in payroll reporting, and recipient exemptions and payment-method exclusions still apply.

Does a split-placement fee require a 1099-NEC?

It can. Review the actual payee's tax classification and payment method, then total qualifying payments for the year. Report the agency's compensation paid to the partner, not automatically the gross client placement invoice.

Are corp-to-corp recruiting payments always exempt?

No. The C2C label does not establish federal tax classification. Ordinary payments to C or S corporations are generally exempt, but partnerships, disregarded LLCs, and applicable exceptions require separate review.

What is the 2026 threshold and filing deadline?

The general 1099-NEC threshold is $2,000 per recipient for tax year 2026, and IRS filing and recipient copies are due February 1, 2027. Backup withholding can require filing below the general threshold.

Can staffing agencies bulk import recruiter records?

Yes. TaxFormHero accepts Excel/CSV imports and manual entry for 1099-NEC. Prepare annual recipient totals, select the correct payer and year, and review drafts before transmission.

Must I file in every state where a recruiter lives?

Not automatically. Review each relevant state's reporting rules and facts, including withholding and income sourcing. Combined Federal/State Filing does not guarantee that every direct state obligation is complete.

What if a recruiter will not provide a TIN?

A missing TIN requires review of the applicable backup-withholding and reporting rules, not simply omission of the recipient. Follow the solicitation requirements and obtain advice about unresolved withholding duties.

One last thing

A staffing agency's placement roster is not its 1099 filing list: classify the relationship and reconcile the actual payments first. Keep incoming client fees, employee payroll, and outgoing nonemployee services distinguishable all year, not only during January preparation.
