A New York business reports 1099 payments to the IRS, not to a separate state portal. For payments made in 2026, you generally issue Form 1099-NEC to each non-employee you paid $2,000 or more for services. You collect a W-9 first, send recipient copies and file with the IRS by January 31, and e-file if you have 10 or more information returns. New York adds a few state-specific points, mainly around withholding and its own penalties. This guide covers each step in order.
TaxFormHero is an IRS-authorized e-filing platform, so you can e-file Form 1099-NEC online without paper or a subscription.
The IRS rule applies the same way in Brooklyn, Buffalo or Albany. A person engaged in a trade or business, including a corporation, partnership, individual, estate or trust, must file information returns for reportable payments and furnish a copy to each recipient.
In practice, that means you review every vendor and individual you paid during the calendar year and ask three questions:
The Forms and associated taxes for independent contractors page says Form 1099-NEC covers payments to people who are not your employees for services in your trade or business. Wages for employees go on Form W-2 instead.
Corporations are often exempt from 1099-NEC reporting, but there are exceptions, such as payments to attorneys. Use the payee’s W-9 and the IRS instructions to decide. Do not assume.
The IRS lists the common categories on its page Am I required to file a Form 1099 or other information return?. Most New York small businesses deal with two forms.
| Form | What it reports | Typical New York example |
|---|---|---|
| 1099-NEC | Nonemployee compensation: services by someone who is not your employee, including parts and materials, cash payments for fish, and payments to attorneys | Freelancers, consultants, subcontractors, per-project professionals |
| 1099-MISC | Rents, royalties, prizes and awards, medical and health care payments, and other income categories | Office rent paid to an individual landlord, prizes, royalties |
| 1099-INT, 1099-DIV, 1099-R, 1099-K | Interest, dividends, retirement distributions, payment card and third-party network transactions | Banks, brokers, plan administrators, payment settlement entities |
The City of New York itself reports most of its vendor payments as nonemployee compensation for services such as consulting, repairs and temporary personnel, according to the NYC Comptroller’s 1099 FAQs. If you invoice the City, expect a 1099 from it.

The IRS confirms that for payments made after December 31, 2025, the Form 1099-NEC threshold rose from $600 to $2,000. Payments made in 2025 and earlier still use the $600 test. The threshold is set to adjust for inflation starting in 2027, so recheck it each year on the IRS instructions for Forms 1099-MISC and 1099-NEC.
Two practical points for New York payers:

Once you have decided a worker is an independent contractor, the IRS says the first step is to have them complete Form W-9. The form gives you the payee’s correct name and taxpayer identification number (TIN). The IRS says to keep the W-9 in your files for four years.
The same IRS page notes that backup withholding of 24% applies to reportable payments when a payee has not provided a TIN as required. That is a good reason to get the form at onboarding, not at year-end.
A simple intake routine:
Under the brand voice we use throughout, the rule is short: no W-9, no payment.
For payments made in 2026, the filing season runs in early 2027. The IRS rules in its Information return reporting guidance are:
| Form | Recipient copy | IRS filing deadline |
|---|---|---|
| 1099-NEC | January 31 | January 31 |
| 1099-MISC | Generally January 31 | February 28 on paper, March 31 if filed electronically |
The 1099-NEC has no extra time for electronic filers, so the January 31 date is firm. When January 31 falls on a weekend, the due date moves to the next business day. In the 2026 season, for example, recipient copies and 1099-NEC IRS filings were due February 2. Confirm the exact date for the current season on the IRS site.
Because 1099-NEC work lands in the same weeks as W-2 work and year-end close, New York firms with many contractors should start in December. Our guide to the 1099-NEC deadline and IRIS TCC steps walks through the timeline.
The IRS says filers with 10 or more information returns must file them electronically. The count includes all return types in the calendar year, not each form alone. A New York business with six 1099-NECs, three 1099-MISCs and a few W-2s can cross the line without noticing.

To e-file directly with the IRS, you use the IRIS taxpayer portal or the FIRE system. Direct filing needs a Transmitter Control Code (TCC), and the IRS says the TCC application can take up to 45 days to process. If you plan to file directly in January, apply well before then.
The other route is an IRS-authorized e-file provider that transmits for you. That avoids the TCC application on your side. We cover the option in the promo section below.
New York has no separate 1099-NEC filing portal for ordinary contractor payments. Most New York businesses file with the IRS and send recipients their copies. State-level reporting comes up in these situations:
If you also pay contractors in other states, check each state’s rules. Some states require a separate 1099 filing even without withholding. Our post on state penalties for 1099-NEC explains how state-level obligations differ.
Federal penalties for information returns are tiered by how late you file. They apply separately to the copy sent to the IRS and the copy furnished to the recipient. The amounts rise the longer the delay, and intentional disregard carries the highest rate. Current per-form amounts are listed on the IRS penalty pages, and our guides on the penalty tiers for missed 1099 deadlines and same-day fixes that reduce 1099 penalties show how they stack up.
New York can add its own penalties on top. Check the Tax Department for the current amounts if you are required to file state information returns.
To reduce exposure:
Our pricing is per form, with no subscription, signup fee or annual contract. It is graduated, so each tier applies only to the forms within it. For 1099 forms:
| Forms in the order | Price per form |
|---|---|
| Forms 1 to 150 | $1.99 |
| Forms 151 to 500 | $0.99 |
| Forms 501 to 1,000 | $0.60 |
| Forms above 1,000 | $0.45 |
Optional services are priced per form: state filing $0.99, print and mail $1.69, encrypted e-delivery $0.19 and TIN matching $0.49 per verification.
Example: a New York agency with 200 contractors pays 150 × $1.99 = $298.50 for the first tier and 50 × $0.99 = $49.50 for the next. The 1099 filing total is $348.00, before any add-ons. A firm with 40 contractors pays 40 × $1.99 = $79.60.
Most 1099 problems we see start before filing. A missing W-9, a TIN that does not match the name, or a contractor total no one added up are the usual causes. By January, these are expensive to fix.
That is why we built TaxFormHero around the whole workflow: collect the W-9, verify the TIN, organize recipient data, then file. We are IRS-authorized and hold a SOC 2 Type I attestation. Our graduated per-form pricing means you pay for what you file, and the rate drops as your volume grows.
For New York accounting firms and bookkeepers with many clients, we support Excel and CSV bulk import and multiple payer accounts. Recipient copies can go out by encrypted email or USPS First-Class Mail, and recipients can download PDF copies for free. We want the January rush to be a routine task, not a crisis.

If you have decided which forms you need, you can prepare and e-file them on TaxFormHero. We are an IRS-authorized platform. Supported 1099 returns are transmitted to the IRS through IRIS A2A. You can enter recipients by hand, import records from Excel, or connect Xero or Zoho Books to bring in data.

W-2 and W-2c forms go to the Social Security Administration, and ACA returns use the IRS AIR system, so you can handle year-end forms in one place. State filing is available for 41+ states and Washington, D.C. See the full price list or start on TaxFormHero. Firms with high volumes can look at our enterprise information return filing option.
Usually not. Most New York businesses file 1099s with the IRS and give copies to recipients. State reporting applies mainly when New York State, New York City or Yonkers income tax was withheld, so confirm with the Tax Department if that describes you.
For 2026 payments, no 1099-NEC is required below the $2,000 threshold. For payments made in 2025 and earlier, the threshold was $600. Still collect a W-9, since annual totals are hard to predict.
The IRS says to keep the W-9 in your files for four years. Store it securely, because it contains TINs.
If you file 10 or more information returns in a calendar year, you must file them electronically. That count combines 1099s, W-2s and other information return types. Direct IRS filing requires a TCC, which can take up to 45 days to process.
It depends on the payee’s tax classification and the type of payment. Corporations are often exempt from 1099-NEC, but payments to attorneys are reportable. Read the payee’s W-9 and the IRS instructions for each case.
