A Texas small business reports contractor and other non-wage payments to the IRS on 1099 forms. For payments made in 2026, the reporting threshold for many 1099-NEC and 1099-MISC categories is $2,000. Payments made before 2026 generally use the $600 threshold. Texas has no individual income tax, so the work is mostly federal. This guide covers which form applies, who gets one, what to collect, when it is due and what a mistake costs.
Need to get this filed? You can e-file Form 1099-NEC online with TaxFormHero, which is IRS-authorized and charges per form, not per month.
The IRS guide to information returns lists the common forms. Most small businesses need only two of them.
| Form | What it reports | Typical Texas example |
|---|---|---|
| 1099-NEC | Nonemployee compensation, including payments to attorneys for services | A landscaper, freelance designer or independent bookkeeper |
| 1099-MISC | Rents, royalties, prizes and awards, medical and health-care payments, and other listed items | Office rent paid to an individual landlord |
| 1099-K | Payment-card and third-party-network transactions | Filed by the payment processor, not by you |
| 1099-INT, 1099-DIV | Reportable interest or dividends | Mostly financial institutions and funds |
The IRS filing requirement page says 1099-NEC covers services by nonemployees, certain fish purchases and attorney service payments. It says 1099-MISC covers rents, royalties, prizes, medical payments and several other categories.
Payments that the payment settlement entity reports on Form 1099-K are generally not reported again on 1099-MISC or 1099-NEC. The IRS instructions for Forms 1099-MISC and 1099-NEC state this rule. So if you pay a vendor by credit card or a payment app, you usually do not issue that vendor a 1099.
Not sure which of the two main forms fits? Our comparison of 1099-NEC and 1099-MISC walks through the boxes. If a contractor also gets paid through a card network, see 1099-K versus 1099-NEC.
The IRS lists four conditions for reporting nonemployee compensation:
Wages paid to employees go on Form W-2, not a 1099, as the IRS page on forms for independent contractors explains.
The IRS instructions describe these exceptions:
Nonprofit organizations and government agencies can also be subject to the reporting rules, according to the same instructions.
For payments made in 2026, the IRS sets the threshold for many 1099-NEC and 1099-MISC categories at $2,000. It is a total for the calendar year per payee, not per invoice. Some categories are different. According to the IRS guide to information returns, royalties and certain broker or substitute payments have a $10 threshold, and some 1099-MISC categories are reportable at any amount.

A practical rule: track every contractor’s year-to-date total in your books from the first payment. Our guides on the 2026 threshold change and on avoiding missed 1099s show how to set up that tracking. To see what counts toward the total, read how to calculate nonemployee compensation.
Texas has no individual income tax. In practice, that means no state income-tax withholding on contractor payments and no state copy of a 1099-NEC to send to a Texas revenue agency for individual payees. Confirm your own situation with the Texas Comptroller of Public Accounts, which administers state business taxes such as franchise tax and sales tax. Those taxes are separate from 1099 reporting.
Two cautions apply:
Have each contractor complete Form W-9 first. The IRS says the form requests the payee’s correct name and TIN. The W-9 records the following:
These fields are described in a W-9 walkthrough. For foreign-owned contractors, the paperwork differs. A guide to contractor tax classification and identification forms explains the W-8BEN-E for Brazilian companies, which is the form such a payee gives instead of a W-9.
Do this at onboarding, not in January. A W-9 gives you the identity and TIN data you need for IRS matching, and it lowers the risk of backup withholding. Store the signed form with the contractor’s file.
A typo in a name or TIN is the most common avoidable error. A TIN check compares the name and number against IRS records before you submit. On TaxFormHero, TIN matching costs $0.49 per verification.
The process has four steps:
The IRS requires electronic filing when you have 10 or more information returns. The count combines nearly all return types, including W-2 forms filed with the Social Security Administration. A business with six contractors and five employees has 11 returns and must e-file. Total volume, not the number of 1099s alone, is the number to watch.
Form 1096 accompanies a paper 1099-NEC but is not required for electronic filing. The IRS also offers the IRIS Taxpayer Portal, a no-cost method that supports keyed entry or CSV upload, and identifies FIRE as another filing system.
For 2026 returns, the IRS instructions set these dates:
| Form | Recipient copy | IRS |
|---|---|---|
| 1099-NEC | January 31 | January 31, paper or electronic |
| 1099-MISC | January 31 | February 28 on paper, March 31 electronically |
When a due date lands on a Saturday, Sunday or legal holiday, it moves to the next business day. January 31, 2027 is a Sunday, so the practical date for payments made in 2026 is Monday, February 1, 2027. Because the January date applies to the IRS filing as well, you cannot treat March as a grace period for 1099-NEC.
For returns and statements due in 2026, the IRS information return penalties are per return:
| When filed or furnished | Penalty per return |
|---|---|
| Within 30 days after the due date | $60 |
| 31 days late through August 1 | $130 |
| After August 1, or not filed | $340 |
| Intentional disregard | $680, no annual maximum |
The same page lists the 2026 annual caps for small businesses: $239,000, $683,000 and $1,366,000 for the three standard tiers. Intentional disregard has no cap. The penalty applies to the IRS copy and to the recipient statement separately, so one late contractor form can cost more than one penalty.
The tier is set by timing, so a same-day fix matters. See how to cut penalties from $340 to $60 and the full penalty tier checklist.

Correct as soon as you find the error. The IRS instructions say to follow the current Publication 1099 for paper corrections. For electronic corrections, follow Publication 5718 for IRIS A2A or Publication 5717 for the IRIS Portal. Do not check the VOID box on a paper correction. Both are covered in the IRS instructions.
Say an Austin remodeling company pays a framing subcontractor $8,400, a freelance designer $1,800 and a landlord $24,000 in rent over 2026. It also paid its supply vendor by credit card.
Trades have extra wrinkles. See our guide on 1099-NEC for HVAC and plumbing subcontractors, and the walkthrough on paying someone with a 1099.
Most 1099 problems we see start months before filing. A missing W-9, a name that does not match the TIN, or a contractor total nobody tracked turns a ten-minute task into a penalty notice.
We built TaxFormHero around that reality. Pricing is per form, with no subscription, signup fee or annual contract, so a Texas business with five contractors pays for five forms. Pricing is graduated: each tier applies only to the forms inside it. For 1099 forms, the first 150 cost $1.99 each, forms 151 to 500 cost $0.99, forms 501 to 1,000 cost $0.60, and forms above 1,000 cost $0.45.
We are IRS-authorized and hold a SOC 2 Type I attestation. Recipients can download free PDF copies, and we support Excel and CSV bulk import for payers with many records. We believe the way to avoid penalties is to verify TINs early and file with the right form on the first try.

When your totals are ready, you can prepare and e-file on our platform. Enter recipients manually or import them from a spreadsheet, then add the options you need. 1099 forms start at $1.99 each. Add-ons are priced per form: state filing $0.99, print and mail $1.69, encrypted e-delivery $0.19 and TIN matching $0.49. Texas has no state copy for individual payees, so most Texas-only filers skip the state option.

Start on the 1099-NEC filing page, or see all add-on prices. Firms with large volumes can look at enterprise information return filing.
Texas has no individual income tax, so there is generally no state income-tax filing tied to 1099s for individual payees. You still file federally. Confirm anything unusual with the Texas Comptroller or a CPA.
It depends on how the LLC is taxed, which its W-9 shows in the federal tax classification. Payments to corporations are generally not reportable, except medical and legal services. A single-member LLC taxed as a sole proprietor is typically reportable.
If you file 10 or more information returns in total, you must e-file. The count includes W-2s and most other return types. Under that number, paper filing with Form 1096 is still available for 1099-NEC.
Backup withholding may apply when a payee gives no valid TIN. The retrieved guidance puts the federal rate at 24%. Document your request and talk to your CPA about withholding before you pay.
